SALEM, Ore. — The Oregon House of Representatives ousted Republican Rep. Mike Nearman Thursday night, the first time in state history a sitting Oregon lawmaker has been expelled.
The tally was 59-1, with the only vote against coming from Nearman himself. He showed no contrition during brief comments on the floor of the House.
Nearman was removed for the disorderly behavior of allowing rioters into the closed Capitol building during a special legislative session on Dec. 21, 2020.
His actions led to dozens of people — some armed and wearing body armor — gaining access to the Capitol, thousands of dollars in damage and six injured Salem and Oregon State police officers.

The reproductive health care bill blamed for the walkout has lots of different policies in it, ranging from requiring insurance to cover gender-affirming care disallowing excessive noise meant to disrupt the work of medical clinics
Republicans walked out of the Oregon Senate this week in large part to avoid a vote on a reproductive health care bill that passed the House on Monday. The bill passed despite delay tactics in the House and 6 hours of floor debate. OPB covered that debate and the contents of the bill on Tuesday, publishing a story shortly before the walkout commenced. Below is the short version of that story — just four main things to know about the bill that has caused Republican state senators to walk out of the statehouse again.

What makes this bill confusing?
HB 2002 is an omnibus bill, meaning there are a lot of different policies in it, all loosely related to reproductive health care and health care for people who are transgender or nonbinary.
Adding to the confusion, Republicans are using the bill as an opportunity to debate some other Oregon laws, already on the books, that they vehemently oppose.
For example, one of Republicans’ central arguments is that children should not be allowed to access gender-affirming care, like hormone blockers, without their parent’s consent.
That’s not in HB 2002. It’s established state law.
In Oregon, youth have the right to consent to their own medical care, including gender-affirming care, starting at age 15.
Would this bill change parents’ rights to object to medical care for their children?
The bill does not change when an adolescent can receive gender-affirming care without parental consent. That age is 15 under current Oregon law.
Here’s what it does change: The bill clarifies that parental consent is not required for children under the age of 15 to receive an abortion.
And it would allow adolescents of any age to get specific types of reproductive health care, including contraception, STI treatment, and pre- and postnatal care without parental consent.
Whether or not that’s a big change depends on how to interpret overlapping state and federal law.
Right now, Oregon does not have any specific laws that require parental consent or notification for abortion at any age.

Oregon used to have a statute that required parental consent for abortions, but it was repealed in the 1980s after the U.S. Supreme Court held that it was unconstitutional to give a parent absolute veto power over their child’s abortion.
Now that Roe v. Wade has been overturned and there’s no federal constitutional right to abortion, it’s possible that Oregon’s general law that establishes 15 as the age of medical consent could apply to abortions too. In practice, some reproductive health clinics in Oregon have required parental consent for minors under 15.
In general, while it’s relatively common for adolescents who are 15 to 19 years old to get an abortion, it’s rare for people under 15. The most recent data in Oregon is from 2021. That year, there were 14 abortions for children under the age of 15.
HB 2002 would also limit the situations in which a medical provider can disclose to a parent that their child has had an abortion or sought contraception or other reproductive health care if the child objects to that disclosure.
So what does this bill change when it comes to access to health care for transgender people?
Oregon already requires state Medicaid and most private medical insurers to cover some gender-affirming care, including hormone therapy and some surgeries.
The bill would expand the scope of care Medicaid and private insurance is required to cover to include things like laser hair removal and facial feminization surgery.
More broadly, it makes it harder for private health insurance plans and the state’s Medicaid providers to deny or limit coverage for gender-affirming treatment, if a doctor has judged the treatment is medically necessary.
What else does the bill do?
The proposed changes to parental consent law and the expansion of gender-affirming care are the main points of controversy. But the bill does many other things. Among them, it attempts to protect health care providers who perform abortions or provide gender-affirming care in Oregon from facing legal consequences due to laws in other states that restrict or criminalize providing those services.
For example, it prevents insurance companies that provide malpractice insurance to doctors in Oregon from penalizing them or raising their rates based on the fact that they provide abortions or gender-affirming care.
It would create a pilot project to deploy two mobile health clinics to provide abortion, gender-affirming care and other reproductive health services in rural areas. And it requires student health centers to provide enrolled students with access to emergency contraception and medication abortion.
The bill would also make it a crime to block people who are trying to enter a health care facility. And it would outlaw making excessive noise or excessive unnecessary phone calls that interfere with a facility’s operations.
And it repeals a state law that makes it a misdemeanor crime to conceal the corpse of an infant.
Democrats framed the bill as an effort to protect patients’ privacy rights, close gaps in insurance coverage, and increase access to abortion and gender-affirming care in rural parts of the state.

Michael J. Nearman[2] (born 1963 or 1964) is an American politician who served as a member of the Oregon House of Representatives from the 23rd district from 2015 until 2021, when he was expelled from the house for his role in the December 2020 Oregon State Capitol breach.
Early life and career[edit]
Born and raised in Oregon, Nearman graduated from Jesuit High School in Beaverton. Nearman earned a Bachelor of Arts degree in philosophy from Marquette University before returning to Oregon to work for his family’s furniture business. Years later, Nearman earned a Bachelor of Science degree in computer science from Western Oregon University.[3]
Prior to entering politics, Nearman worked as a dishwasher, gravedigger, taxicab driver, and technical support representative. From 2010 to 2015, Nearman worked as a software engineer for UTC Climate, Controls & Security.[4]
Oregon House of Representatives[edit]
Nearman was elected to the Oregon House of Representatives in 2014 after defeating incumbent Representative Jim Thompson in the Republican primary election. The Oregonian reported that Nearman was buoyed by conservative opposition to Thompson’s more progressive stances on social issues such as same-sex marriage and abortion rights.[5]
Nearman is one of two petitioners filing ballot measure IP 5, which would require all Oregonians to re-register in order to vote, and to show a state official a birth certificate, passport, or other documentation in order to register.[6]

2020 Oregon Capitol breach[edit]

During a special session on December 21, 2020, Nearman let armed protesters into the Oregon State Capitol to protest against health restrictions related to the COVID-19 pandemic in Oregon.[8][9] Joey Gibson, political activist and founder of Patriot Prayer, posted a video on Parler indicating a state representative let the group into the capitol,[10] and in January 2021 security video was released of Nearman allowing similar right-wing protesters to enter the Oregon State Capitol Building through a door.[11]
Oregon House Speaker Tina Kotek fined Nearman $2,000 and stripped him of his committee assignments and appointments. Kotek also asked him to resign. Kotek and others filed a formal complaint about Nearman’s actions creating a hostile workplace. Nearman also gave up his Capitol building badge; he agreed not to let unauthorized people into the building and was required to give 24 hours notice before entering the building. Oregon State Police opened a criminal investigation against him.[12][13][14]
On April 30, 2021, prosecutors charged Nearman with official misconduct in the first degree (Class A misdemeanor, punishable by a maximum 364 days in prison and a US$6,250 fine) and criminal trespass in the second degree (Class C misdemeanor, punishable by a maximum of 30 days in jail and a $1,250 fine).[15] Nearman did not appear in court on May 11 when he was arraigned on the charges, and his attorney did not file a plea. Nearman must appear in court in person or remotely for a June 29 hearing.[16]
In June 2021, video was discovered of a meeting at the office of the Freedom Foundation on December 16, 2020, during which Nearman detailed his plan to allow protestors entry to the capitol, which he dubbed “Operation Hall Pass”. He gave out a cell phone number, which was his, and said that by calling that “random number” to say that they are at the West entrance, somebody may open the door on their way out.[17]
On July 27, 2021, Nearman pleaded guilty to one count of official misconduct in the first degree as part of a plea agreement. In exchange for his guilty plea, Nearman received 18 months of probation, and must complete 80 hours of community service during his probation. Furthermore, he will have to pay $2,700 in fines for damages done to the Capitol during the riot, and is also banned from the Capitol building and its grounds.[18]
Expulsion[edit]
On June 10, 2021, the Oregon House of Representatives voted 59–1 to expel Nearman on the grounds of “disorderly behavior”; the sole vote against was cast by Nearman himself. He is the first member to be expelled in the state’s history.[19]

After seeing our Governor on MSNBC, yesterday I wrote down on my note pad ideas on passing a Bill in the Legislator that will guarantee all Oregonians – and not just some – will have total access to Healthcare and Abortions’ as they existed before the repeal of Roe vs. Wade.

The Constitution can legislate behavior, but not morality. The unborn are not subject to behavior or moral adjustments while in the womb. A moral adjustment can be made by a moral body of men and women, such as practiced in the Baptism of infants – so they will KNOW ETERNAL LIFE! Can mothers be forced to baptize their infants – for the sake of the infant? Can a mother be fined or imprisoned for denying her child – a means to overcome death – which must occur so their child can live forever? Can a mother kill her child in order to hasten everlasting life?
Most Christian ministers teach a child is inflicted with THE ORIGINAL SIN the moment they are born. Is this child afflicted with sin – while in his mother’s womb? Many learned men wonder about this?
A baby can not commit crimes. A fetus can not break God’s Commandments. Texas passed a law putting the Commandment in public schools. The Ten Commandments – are not the Constitution! There is no Commandment bidding parents to Baptize their infant – to wash away the ORIGINAL SIN! The Jews do not believe in the original sin – and Baptism. Jews in Israel – allow abortion! It is not a crime.
Can the Constitution pass a amendment making it a serious crime to make a GRAVEN IMAGE, where the penalty God prescribes is to – CURSE THE FRUIT OF WOMB – for a thousand generations. Ouch! Can one appeal – to a secular body of laws? This suggests God can, and will make – BORN SINNERS! What is a graven image? Consider the U.S. dime with a image of Mercury on it. Have you ever touched one? If so, you are UNCLEAN, and must make amends on Yom Kippur, THE DAY OF ATONEMENT, that God made so His People can be FREE OF SIN.

Democrats in the Legislature want to ask Oregon voters to write the right to abortion, same-sex marriage and gender-affirming care into the state’s Constitution.
Senate Majority Leader Kate Lieber, D-Beaverton, introduced a joint resolution in the state Senate Wednesday to refer to voters a proposed constitutional amendment. The legislative referral would appear on ballots in November 2024.
The amendment would also repeal language that’s been in Oregon’s Constitution since 2004 defining marriage as being between one man and one woman (Article XV, Section 5a).
That policy hasn’t been in effect since a federal judge in 2014 ruled it unconstitutional — a decision upheld by the U.S. Supreme Court in 2015, which required states to recognize same-sex marriages.

Planned Parenthood, ACLU Oregon and Basic Rights Oregon are campaigning for the proposed amendment, which has broad support from Democrats who control both chambers of the Oregon Legislature. Republicans in the minority just learned of the legislation.
Oregon already has among the strongest protections for abortion and civil rights for LGBTQ+ people in the nation. State laws bar housing and employment discrimination against gay and transgender people, allow for abortions with no specific gestational limit, and require state Medicaid and most private medical insurers to cover abortions and gender-affirming care.
The civil rights advocates say a constitutional amendment creates a more lasting guarantee of those rights, following a decision by a conservative majority on the U.S. Supreme Court to overturn Roe v. Wade. Conservative and Christian activists have also pressed lawmakers to pass a slate of bills in other states under the umbrella of parents’ rights, which have taken aim at gender-affirming care, drag performers and transgender athletes.

“We don’t want Oregon to ever pass any kind of legislation like we’re seeing in other parts of the country that could strip away our right to exist,” said Todd Addams, interim executive director at Basic Rights Oregon. “We don’t want that to be a possibility without a huge, huge fight.”

Addams says members of the LGBTQ+ community in Oregon have wanted to remove the gay marriage ban from Oregon’s Constitution since the Supreme Court’s Obergefell decision in 2015.
Now, the national retrenchment on gay and transgender rights has created a new sense of urgency, with people questioning whether their marriages could be dissolved or they could lose access to medical care.
“This idea that their futures are completely up in the air, and could be stripped away at any moment, is this huge level of anxiety and fear in the community,” Addams said.
Republicans in the legislature were blindsided by the proposed constitutional amendment.
They suggested that the constitutional protections it affords would go further than its advocates have said. For example, they see it as providing a constitutional guarantee that minors can access abortion without parental knowledge.
“Democrats have come back with an attempt to seek retroactive approval of their extreme agenda. SJR 33 is a continuation of the Democrats’ extreme assault on parental rights. With this legislation, the Democrats now want to give 10-year-old girls a constitutional right to abortion without parental knowledge,” said Senate minority leader Tim Knopp, R-Bend, in a written statement.
Oregon law allows minors aged 15 and older to provide consent to medical procedures, including abortions. A reproductive health care bill being considered in this legislative session would eliminate that age requirement for abortions.
That bill passed out of committee last week over Republican objections.
The proposed constitutional amendment does not explicitly address issues of parental consent or the rights of minors.
It also does not address the question of gestational limits to abortion. Oregon is among relatively few states with no specific limit based on the length of pregnancy.
Sandy Chung, the executive director of the ACLU of Oregon, said the amendment would create constitutional “safeguards,” for abortion, but said whether that would block attempts to limit the procedure to a specific point in gestation is “a complicated question.”
Advocates said they are not aware of any current state or local laws in Oregon that would conflict with the amendment’s prohibitions on gender discrimination.
“If there’s a law at any level that would be violating this constitutional right or freedom, then people could go to court to challenge it,” Chung said.
Oregonians have in the past defeated a number of ballot initiatives that sought to restrict abortion. The equal rights amendment in the Oregon Constitution that civil rights groups are now seeking to build on was adopted by voters in 2014.

Hundreds of members of alleged militia groups mobilized over the weekend to protect Republican senators in Oregon who fled the capitol last week in an attempt to block the passage of landmark climate change legislation.
As INSIDER previously reported, upwards of 600 people were expected to mobilize on Saturday, consisting of 21 Oregon III% county groups, five Idaho III% groups, the statewide Nevada III% group, and six independent militias across the state, according to a source with Oregon’s Three Percenters.
Prior to this recent stand-off, the militia group was also involved in the Malheur National Wildlife Refuge takeover in 2016, in which armed protesters took over the refuge headquarters in Oregon.
The source told INSIDER that he doesn’t anticipate violence among Three Percenters, but did acknowledge that “I would not be surprised if every member of the group is armed,” adding that members are willing to “go to any lengths required” to protect the senators.
