At 6,500 feet below the surface, Noble’s well is deeper than BP’s blown out Macondo well. In a worst-case scenario, the company told regulators its well could spill nearly 3 million gallons of oil per day into the Gulf. At its peak, the BP well spilled 2.6 million gallons per day.

The National Defense Authorization Act for Fiscal Year 2010 that President Obama signed into law on October 28th is legislation designed to “authorize appropriations for fiscal year 2010 for military activities of the Department of Defense, to prescribe military personnel strengths for fiscal year 2010, and for other purposes.” One of those “other purposes” was to designate the USS Constitution as America’s Ship of State. The president, vice president, executive branch officials, and members of Congress are now able to use the “Old Ironsides” for purposes such as hosting visiting heads of state, signing legislation relating to the armed forces, and signing maritime-related treaties.

Two years after oil from a BP well began gushing into the Gulf of Mexico, the U.S. Department of Justice has filed criminal charges alleging that a former BP employee destroyed critical evidence in the early days of the unfolding disaster.
The charges are the first to be filed in what the Obama administration has called the worst environmental disaster in American history, and they are significant because they target an individual employee for his actions.
According to an affidavit and complaint filed today in a Louisiana court, Kurt Mix, a former drilling and completions engineer, deleted email and text messages he had sent to senior BP managers estimating that the amount of oil spewing into the Gulf was many times greater than the amount stated publicly. Mix was specifically instructed by attorneys contracted by BP to retain his records before he deleted them, the affidavit states.
In a statement released to reporters, U.S. Attorney General Eric Holder indicated that more charges are likely, describing the indictment as “initial charges” in an ongoing investigation, and saying that the Department of Justice “will hold accountable those who violated the law.”
More than 200 million gallons of crude oil flowed into the Gulf of Mexico after a blowout caused the explosion of the Deepwater Horizon oil rig and the death of 11 workers on April 20, 2010. The spill continued, unabated, for nearly three months. Analysts have long expected criminal charges against BP or its employees.
A spokeswoman for the agency declined to say when more charges might be expected, or to explain why the case against Mix was the first to be made public.
Mix could not be reached for comment, and we were unable to leave him a message because his voicemail was full.
BP issued a statement saying that the company was cooperating with federal investigators and that “BP had clear policies requiring preservation of evidence in this case and has undertaken substantial and ongoing efforts to preserve evidence.”
According to an FBI affidavit submitted to the court along with the indictment, Mix, who worked for BP until January 2012, was directly involved in BP’s efforts to understand how much oil was flowing out of the broken Macondo well. On April 21, 2010, Mix estimated that between 68,000 and 138,000 barrels of oil were leaking each day — far more than the 5,000 barrels that were estimated publicly at the time.
On April 22, Mix received the first of six legal notices instructing him to retain his electronic records.
Yet, according to the affidavit, in early October, Mix allegedly deleted a string of more than 200 text messages on his iPhone that he had sent to a supervisor. The deleted texts, which the Department of Justice said were recovered forensically, included sensitive — and pessimistic — internal BP information sent while the company was attempting what it called a “Top Kill” effort to stop the gushing oil on May 26, 2010.
Mix wrote that the effort — which he was directly involved in — was unlikely to succeed. “Too much flowrate — over 15,000 and too large an orifice. Pumped over 12,800 bbl of mud today plus 5 separate bridging pills. Tired. Going home and getting ready for round three tomorrow.”
At the time, BP said publicly that the measure had a 70 percent chance of success.
Mix, 50, was arrested in Katy, Texas today. If convicted, he faces a maximum penalty of 20 years in prison and a fine of up to $250,000 on each of the two counts he is charged with.

     The following description of Noble-Switzerland’s share capital is a summary. This summary is not complete and is subject to the complete text of Noble-Switzerland’s articles of association and by-laws, which are filed herewith as Exhibits 3.1 and 3.2, respectively, and are incorporated by reference herein. Capital Structure
     Noble-Switzerland only has one class of shares outstanding, registered shares with a par value per share of 5.00 Swiss francs,
      Issued Share Capital.    As of March 27, 2009, the registered share capital of Noble-Switzerland was approximately 1.4 billion Swiss francs, comprised of approximately 276 million registered shares par value 5.00 Swiss francs per share.
      Authorized Share Capital.   Noble-Switzerland’s articles of association provide that the board of directors of Noble-Switzerland may issue new registered shares at any time during a two-year period ending March 26, 2011 and thereby increase the share capital, without obtaining additional shareholder approval, by a maximum amount of 50% of the share capital registered in the commercial register, which is approximately 691 million Swiss francs, or approximately 138 million registered shares. After the expiration of the initial two-year period, authorized share capital will be available to the board of directors for issuance of additional registered shares only if such authorization has been approved by shareholders. Each such authorization may last for up to two years.
     The board of directors determines the time of the issuance, the issuance price, the manner in which the new registered shares have to be paid in, the date from which the new registered shares carry the right to dividends and, subject to the provisions of Noble-Switzerland’s articles of association, the conditions for the exercise of the preemptive rights with respect to the issuance and the allotment of preemptive rights that are not exercised. The board of directors may allow preemptive rights that are not exercised to expire, or it may place such rights or registered shares, the preemptive rights of which have not been exercised, at market conditions or use them otherwise in the interest of Noble-Switzerland.
     In an authorized capital increase, Noble-Switzerland shareholders would have preemptive rights to obtain newly issued registered shares in an amount proportional to the par value of the registered shares they already hold. However, the board of directors may withdraw or limit these preemptive rights in certain circumstances. U.S. Approves First Deepwater Drilling Permit In Gulf Of Mexico Since BP Oil Spill
NEW YORK — The U.S. has approved the first deepwater drilling permit in the Gulf of Mexico since BP’s massive oil spill.
The Bureau of Ocean Energy Management, Regulation and Enforcement announced Monday that it issued a permit to Noble Energy Inc. to continue work on its Santiago well about 70 miles southeast of Venice, La. Drilling will resume nearly one year after BP’s blowout created the worst offshore spill in U.S. history.
Noble started drilling the well four days before the Deepwater Horizon oil rig exploded on April 20. The project was put on hold on June 12 after the U.S. placed a moratorium on exploration in waters deeper than 500 feet.
No new deepwater permits had been issued since the moratorium was lifted in October. Regulators have been under pressure from the oil industry and some lawmakers to get drilling projects started again in the Gulf while ensuring that new safeguards are in place. That pressure increased last week as the price of oil spiked above $100 per barrel and the price of gasoline hit its highest level in two and a half years.

Noble had drilled to a depth of 13,585 feet before the moratorium and has about 5,400 feet to go.
The permit is for a “bypass” well, which allows the driller to take a slightly different path than previously expected. Drilling is expected to recommence in April.
Director Michael Bromwich said that Noble demonstrated it is capable of containing a well blowout, a key requirement for permit approval. Noble contracted with the Helix Well Containment Group to use its emergency capping stack to stop the flow of oil in case it loses control of the well.
Another emergency containment solution, offered by a consortium led by Exxon Mobil Corp., was announced earlier this month.
“We expect further deepwater permits to be approved in coming weeks and months based on the same process that led to the approval of this permit,” Bromwich said.
The U.S. has approved other permits for new wells, including 37 in shallow water, since the moratorium was lifted. It also has approved 22 other applications for activity on deepwater wells that were not suspended by the moratorium.
The approval comes as Interior Secretary Ken Salazar heads to the Capitol this week to defend his agency’s budget request. He is expected to be pressed by lawmakers concerned with rising gasoline prices about how slowly new permits have been issued.
Sen. David Vitter, R-La., a vocal critic of the slowdown in offshore drilling permits, said Monday that “while one deepwater permit is a start, it is by no means reason to celebrate.” Vitter wants 15 deepwater permits issued before he releases a hold on the nomination of President Obama’s pick to head the Fish and Wildlife Service.
House Natural Resources Committee Chairman Doc Hastings, R-Wash., urged regulators to push other applications through quickly. Noble’s project alone “will not ease the economic pain being inflicted on Gulf families.”
Bromwich denied that politics played a role in the timing of the announcement. He said there are eight applications currently pending for deepwater wells.
The Obama administration is seeking a $12 million increase in the former Minerals Management Service budget to hire hundreds of new oil and gas inspectors, engineers, scientists to oversee industry operations; conduct detailed engineering reviews; and more closely review oil spill response plans. Much of the money would come from higher fees and royalty rates on oil and gas companies.

    On April 26, 2012 I posted this prophetic blog. Hence a Oil Pirate Vessel is being blocked from heading out to sea. “Shell was forced to halt its Arctic exploration in 2012 amid a series of severe security mishaps.
    Environmental groups and scientists reacted to Monday’s news badly, warning that letting Shell back into the Arctic for exploration and drilling was very likely to cause an ecological disaster and contribute to climate change.
    According to a US government study from this year, chances of an oil spill occurring as a result of drilling in the Arctic over the next 77 years are as high 75%.
    These are figures well known to community members and activists in Seattle.
